Terms of Service

1. Acceptance of Terms
By accessing or using Design Thinker Labs ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service. Creating an account constitutes your acceptance of these Terms and our Privacy Policy.
2. Eligibility
You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Service. By using the Service, you represent and warrant that you meet this requirement.
3. Description of Service
Design Thinker Labs is a web-based application that guides users through the Design Thinking methodology with AI-assisted tools for ideation, research, prototyping, and testing. The Service includes free and paid tiers with varying feature access and usage limits.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information when creating an account and to update it as necessary. You must notify us immediately of any unauthorized use of your account.
5. User Content
You retain ownership of all content you create using the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing and improving the Service. We do not claim ownership of your User Content and will not use it for purposes unrelated to the Service without your consent.
6. Acceptable Use
You agree not to misuse the Service, including but not limited to: attempting to gain unauthorized access to any part of the Service; interfering with or disrupting the Service or other users' use of the Service; using the Service for any unlawful, fraudulent, or malicious purpose; reverse-engineering, decompiling, or attempting to extract the source code of the Service; or using automated tools to scrape or extract data from the Service.
7. AI-Generated Content
The Service uses artificial intelligence to generate suggestions, research summaries, and other content ("AI Output"). AI Output is provided as-is for informational and creative purposes only. We make no warranties or representations regarding the accuracy, completeness, reliability, or fitness for any particular purpose of AI Output. You are solely responsible for reviewing, validating, and deciding whether to use any AI Output. AI Output should not be treated as professional, legal, medical, or financial advice.
8. Intellectual Property
The Service, including its design, code, features, documentation, and branding, is owned by Design Thinker Labs and protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.
9. Subscription, Billing & Credits
The Service offers free and paid subscription tiers. Paid subscriptions are billed on a recurring basis (monthly or annually) at the rates displayed at the time of purchase. You authorize us to charge your chosen payment method for all applicable fees. Credit packs are one-time purchases that add usage credits to your account. Unused credits remain in your account until used; they have no cash value and are non-transferable between accounts. We reserve the right to modify pricing, credit costs, or tier features with reasonable notice. Existing subscriptions will be honoured for the remainder of the current billing period.
10. No Refund Policy
All paid plans and credit purchases are final and non-refundable. This includes, without limitation:
- Monthly and annual subscription fees — cancellation stops future billing but does not entitle you to a refund for the current or any prior billing period.
- Credit pack purchases — purchased credits are non-refundable regardless of whether they have been used.
- Unused credits — unused credits have no cash value and cannot be redeemed, exchanged, or transferred.
In exceptional circumstances involving extended, verified service unavailability caused solely by us, we may, at our sole discretion, offer service credit or a partial refund. This is not an obligation and will be evaluated on a case-by-case basis.
11. Free Tier & Free Credits
Free-tier accounts receive a limited allocation of credits that reset periodically. Free credits are provided at our discretion and may be modified, reduced, or discontinued at any time without prior notice. Free credits are non-transferable and have no monetary value.
12. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any loss or inconvenience arising from service interruptions, scheduled maintenance, or feature changes.
13. Suspension & Termination
We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms, engaged in abusive or fraudulent conduct, or pose a risk to the Service or other users. Upon termination, your right to use the Service ceases immediately. We may, but are not obligated to, provide you with an opportunity to export your User Content before termination.
14. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements, that it will be uninterrupted or error-free, or that any defects will be corrected.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Design Thinker Labs and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of or inability to use the Service, regardless of the theory of liability. Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.
16. Indemnification
You agree to indemnify, defend, and hold harmless Design Thinker Labs and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: your use of the Service; your violation of these Terms; your violation of any third-party rights; or any User Content you submit through the Service.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region ("Hong Kong"), without regard to its conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts of Hong Kong for the resolution of any disputes arising under or in connection with these Terms.
18. Dispute Resolution
Before initiating any formal legal proceedings, you agree to first contact us and attempt to resolve the dispute informally for a period of at least thirty (30) days. If the dispute cannot be resolved informally, either party may pursue resolution through the courts of Hong Kong as set forth in Section 17.
19. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
20. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.
